How to apply for a Waiver
Under the Immigration and Nationality Act of the United States there are certain criteria that establish the admissibility to the country. The application for a waiver will depend on your case. However, there is a classification that will allow you to determine what kind of waiver you are eligible for.
You can apply for a I-601 waiver when you are ineligible to enter the United States for specific grounds of admissibility. Some of them are related with certain crimes, Immigration fraud and misrepresentation, have been subject to civil penalty, health-related grounds of inadmissibility among others.
The I-601A waiver is called a provisional unlawful presence waiver application because it only applies to persons who entered the United States illegally and who also has an immediate relative U.S Citizen or Legal Permanent Resident.
And the I-212 is applicable for those who have been previously deported or removed from the United States.
